Termination Of The Contract Of The Office Space Lease

Abstract

The subject of this paper is analysis of the special ways in which terminate the office space lease in the legal system of the Republic of Srpska. Since this is a special type of lease that applies special act, Law on the Lease of business buildings and premises which dates from the period of the former Socialist Republic of Bosnia and Herzegovina, with the subsidiary implementation of the Law of Obligations, so and the termination of this contractual relationship is characterized by elements which are differentia specifica in relation to the desuetude of the lease in general. Bearing in mind that this fact and the specific solution of a observed legal system in relation to neighboring countries, the author has endeavored, in particular, by comparative analysis and review of current judicial practice, to illuminate on this law issue. In addition, special attention was paid to the legal "focus", i.e. those issues in the domain of the problem, which in the case law cause most dilemmas.
