LEGAL STATE AS PRECODITION FOR REALIZATION OF FUNDAMENTAL HUMAN RIGHTS AND FREEDOMS OF CITIZENS

Abstract

 Legal state, that is, a rule of law is precondition for realization of fundamental rights and freedoms of citizens in a state. Legal state in that way can exist only if all institutions of the government (all authorities) work and act based on legality and fairness, as well as legal certainty for all citizens that live in state. What needs to be emphasized about legal state and the rule of law is its role in everyday life. Rule of law does not represent rule of any law, but rule of that what law needs to be for citizens and state in general, in order to provide complete legal protection and security of citizens. Also, special attention was paid to role that legal state should have in progress of the state, including economic and business development, and how does it influence on social trends, as well as on functioning of authorities. At the same time, we must not ignore the fact that legal state and rule of law are basis for legal certainty in state, not only for citizens and their freedoms, but for the progress of free market, the financial investments, the influx of capital from the state and from foreign counties. These investments are directly dependent on existing of legal and financial security in the country.
