HUMAN RIGHTS, AND MINORITY RIGHTS

Abstract

 Human rights are the derivative of the very native of human being. They represent the imperative of nowadays. In order to understand this, it should be understood notions of philosophers, theologians and jurists during the history. Term “human rghts“ can't be found among philosophers, theologians and jurists, but the concept was implicit in perceptions about religion, which tells about human beings, created by God (in terms of better vassals, love toward the neighbours, fundamental value of life and love and striving towards a single humanity). Great legal codes, such as the one of Hammurabi and Justinian, promote the justice as a permanent will and aspiration of man to a man. Here, should be for the moment, ignored discrimination of „man“ (eg. slaves) and „gender“ (eg. recent female discrimination).First and comprehensive document by which were regulated and normatively listed attitudes on human rights, and protection of the same is Universal Declaration of Human Rights. Universal Declaration of Human Rights is declaration which was adopted by General Assembly of United Nations (on December 10,1948.) by which was presented the general perception of organization on the issue of human rights guaranteed to people. After the end of World War II, have emerged the crimes committed by Nazi Germany, which has led to that there was a general opinion in world community that Charter of the United Nations dosn't release enough rights which should be protected. Since it was created as a declaration of aims and objectives, which should comply with governments, is not legally binding and that for has no signatories. Declaration doesn't represent the part of internatonal right, but represents a significant tool in applying diplomatic and moral pressure on governments that violate some or all of the provisions of the Declaration.In the framework of moral principles and norms, referring to human rights, there are also norms which regulate the rights and obligations of minorities. Such as human rights, they are also regulated by the Constitution of Bosnia and Herzegovina
